Decision of the Prophet

Surah ‘An-Nisaaa’  (Women) – Chapter – 4) 

‘A-‘uu-zu  Billaahi minash-Shay-taanir- Rajiim.

Bis-Millaahir-Rah-maanir-Rahiim.

(In the name of God, the Beneficent, the Merciful)

         أَلَمْ تَرَ إِلَى ٱلَّذِينَ يَزْعُمُونَ أَنَّهُمْ ءَامَنُوا۟ بِمَآ أُنزِلَ إِلَيْكَ وَمَآ أُنزِلَ مِن قَبْلِكَ يُرِيدُونَ أَن يَتَحَاكَمُوٓا۟ إِلَى ٱلطَّٰغُوتِ وَقَدْ أُمِرُوٓا۟ أَنيَكْفُرُوا۟ بِهِۦ وَيُرِيدُ ٱلشَّيْطَٰنُ أَن يُضِلَّهُمْ ضَلَٰلًۢا بَعِيدًا 60

60.  Hast thou not seen those who pretend that they believe in that which is revealed unto thee and that which was revealed before thee, how they would go for judgment (in their disputes) to false deities when they have been ordered to abjure them? And Satan only wishes to mislead them for astray.   
60.‘Alam  tara  ‘ilallaziina  yaz-‘umuuna  ‘annahum  ‘aamanuu  bimaaa  ‘unzila  ‘ilayka  wa  maaa  ‘unzila  min-qablika  yuriiduuna  ‘any-yatahaakamuu  ‘ilat-taaguuti  wa  qad  ‘umiruu  ‘any-yakfuruu  bih.  Wa  yurii-dush-Shay-taanu  ‘any-yuzillahum  zalaalam-ba-‘iidaa.

Commentary

The children of Israel (the Jews) used to support and show partiality during the act of judging the law-suits usually by taking bribes etc. Maximum Hypocrites of Madinah used to refer their matters to the scholars of the Jews for the purpose that they would show them favor. They did not use to come unto the Messenger of Allah Almighty (grace, glory, blessings and peace be upon him) because they did know that the Messenger (grace, glory, blessings and peace be upon him) would judge according to the just and fact, and would not show partiality for anyone.

Once, a person from the Jews and a Hypocrite quarreled with each other. The Jew was true. He said, “Let’s refer the matter to the Messenger (grace, glory, blessings and peace be upon him) for judgment”. The Hypocrite was a liar. He strengthened that the matter should be referred to the scholar of the Jews “Ka’b bin Ashraf”. Eventually they both brought the dispute to the Messenger (grace, glory, blessings and peace be upon him). He (grace, glory, blessings and peace be upon him) settled the matter in favor of the Jew. After coming out from that place, the Hypocrite said to the Jew, “I don’t accept this decision. Let’s go to Omar (may Allah Almighty be pleased with him), I shall accept that, which he (may Allah Almighty be pleased with him) will decide”.  

The both persons (the Jew and the Hypocrite) reported to Omar (may Allah Almighty be pleased with him) and told about their dispute. When Omar (may Allah Almighty be pleased with him) heard from the Jew that the matter had already been presented in the court of Muhammad (grace, glory, blessings and peace be upon him) and He had finalized the case in the favor of the Jew. Then Omar (may Allah Almighty be pleased with him) drew the sword, killed the Hypocrite and said, “It is the decision for him, who does not accept the judgment of the Messenger of Allah Almighty (grace, glory, blessings and peace be upon him)”.  

The heirs of the Hypocrite reported the matter in the court of Messenger (grace, glory, blessings and peace be upon him) and sued against Omar (may Allah Almighty be pleased with him) regarding execution of the Hypocrite. They began to swear that the matter was brought to Him only for the purpose that a truce might be made mutually among them (the Jew and the Hypocrite) by him (may Allah Almighty be pleased with him).

At this occasion, this verse was revealed, in which real fact was disclosed. Omar (may Allah Almighty be pleased with him) was bestowed with the title of “Faaruuq” (the Finder of the difference) upon this act.

Settling the disputes

Surah ‘An-Nisaaa’  (Women) – Chapter – 4)

         يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوٓا۟ أَطِيعُوا۟ ٱللَّهَ وَأَطِيعُوا۟ٱلرَّسُولَ وَأُو۟لِى ٱلْأَمْرِ مِنكُمْ فَإِن تَنَٰزَعْتُمْ فِى شَىْءٍ فَرُدُّوهُ إِلَى ٱللَّهِ وَٱلرَّسُولِ إِن كُنتُمْ تُؤْمِنُونَ بِٱللَّهِ وَٱلْيَوْمِ ٱلْءَاخِرِ ذَٰلِكَ خَيْرٌ وَأَحْسَنُ تَأْوِيلًا 59

59b.  Then if ye have a dispute concerning any matter, refer it to Allah and the Messenger if ye are (in truth) believers in Allah and the Last Day. That is better and more seemly in the end. 
59b.  Fa-‘in  tanaaza’-tum  fii  shay-‘in-  fa-rudduuhu  ‘ilAllaahi  war-Rasuuli  ‘in-kuntum  tu’-minuuna  Billaahi  wal-Yawmil-‘Aakhir.  Zaalika  khayrunw-wa  ‘ahsanu  ta’-wiilaa.

Commentary

Tanaaza’-tum  - (you have a dispute). The words nazaa’ and tanaaza-‘a have also been derived from the same origin, which means ‘to quarrel, to dispute, to argue, misunderstanding, contradiction and to oppose.

Rudduuhu  - (refer to), there are many other words from its derivation like ‘irtadaad, murtad etc. Actual aim is ‘to invert, to return towards the Law of Allah Almighty and the traditions of the Last Messenger (grace, glory, blessings and peace be upon him) in case of a dispute concerning any matter. That is to say, the decision of the dispute should be finalized in the light of the Will of Allah Almighty and His Last Messenger (grace, glory, blessings and peace be upon him).

We have been guided by Allah Almighty, “If any mutual misunderstanding arises among you and your officials concerning any matter that, whether the command of the ruler is suitable or opposite, then the Scripture (Holy Qur’an) of Allah Almighty and Sayings of His Messenger (grace, glory, blessings and peace be upon him) should be consulted, and brought it to a conclusion. Then the result, which has been settled, that should be considered mutually correct and fit. And if you (in truth) believe in Allah Almighty and the Last Day, then your (belief) will demand that you should refer the case to the Command of Allah Almighty and Sayings of His Messenger (grace, glory, blessings and peace be upon him), and that belief will excite you to fear from Their opposition.

We knew from it that the person, who will run away from the command of Allah Almighty and Sayings of His Messenger (grace, glory, blessings and peace be upon him), is not a Muslim. Therefore, if two Muslims have any dispute with each other, one of both said, “Let’s refer to Law of Divine”. The other said, “I don’t have any regard to the Law of Divine” or “I am not concerned with any Divine way of religion”, then that person is not believer, otherwise he would not have said such words.

Allah Almighty describes, “If you will refer your disputes and discords to Allah and Messenger (grace, glory, blessings and peace be upon him), and obey Them, then it will be better for you. Result of referring the matters to Allah And His Messenger (grace, glory, blessings and peace be upon him) is better than quarreling with one another or deciding according to own opinions.

Today, we observe that the Muslims quarrel with one another and instead of taking decision from Holy Qur’an, they refer their cases to other non-Islamic Laws. The only reason of it is that they keep the casual and closely results in view. They do not know that doing so, they spoil their end (the Day of Resurrection). If they obey the commands of Allah Almighty, their result may be better and more seemly in the end.

Who is worthy of obedience

Surah ‘An-Nisaaa’  (Women) – Chapter – 4)

         يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوٓا۟ أَطِيعُوا۟ ٱللَّهَ وَأَطِيعُوا۟ٱلرَّسُولَ وَأُو۟لِى ٱلْأَمْرِ مِنكُمْ فَإِن تَنَٰزَعْتُمْ فِى شَىْءٍ فَرُدُّوهُ إِلَى ٱللَّهِ وَٱلرَّسُولِ إِن كُنتُمْ تُؤْمِنُونَ بِٱللَّهِ وَٱلْيَوْمِ ٱلْءَاخِرِ ذَٰلِكَ خَيْرٌ وَأَحْسَنُ تَأْوِيلًا 59

59a.  O ye who believe! Obey Allah, and obey the Messenger and those of you who are in authority.
59a.  Yaaa-‘ayyu-hallaziina  ‘aa-manuuu  ‘atii-‘Ullaaha  wa  ‘atii-‘ur-Rasuula  wa  ‘ulil-‘amri  min-kum.

Commentary

This verse is soul of Islamic political and general administrative system and key to fundamental principles of the country. A very important matter has been described in this verse. That is to say, who should be obeyed by the mankind in the matters of his/her life and heed the bidding of whom?

It is the miracle of the Word of Allah Almighty to narrate too much important and original subject in one sentence only. If we keep the order of this sentence in sight, then a lot of misapprehensions and depravities are dispelled, and those bondage, which human beings have adhered upon themselves, are broken.   

It is being ordered: Yaaa-‘ayyu-hallaziina  ‘aa-manuuu – (O ye who believe)!

  1. ‘Atii-‘Ullaaha  (Obey Allah)

  1. wa  ‘atii-‘ur-Rasuula  (and obey the Messenger)

  1. wa  ‘ulil-‘amri  min-kum  (and those of you who are in authority)

Obedience of Allah Almighty will be through the Law, He revealed. He informed the humankind in every time about His Will. The person, who obeyed His instructions, succeeded and obtained deliverance.  

Obedience of the Messenger (grace, glory, blessings and peace be upon him) will be in the form of following His actions, sayings and motions. The Prophets and Messengers (peace be upon them) were sent in each dwelling and village. After them, Muhammad (grace, glory, blessings and peace be upon him) came in the world as the last Messenger (Khatamul-Mursaliin). The human being, who will follow the Comely Model Role(‘Uswatun Hasanah) of the Messenger of Allah Almighty (grace, glory, blessings and peace be upon him), he/she will be fortunate, successful and beloved of Allah Almighty.

Obedience of ‘ulil-‘amr (those of you who are in authority) will be done by means of acting upon the laws and guidance issued by the ruler, provided that he is from the Muslims. The condition of min-kum (those of you) has discharged the Muslims from obedience of any transgressor, mischievous or rebel of Allah Almighty and His Messenger (grace, glory, blessings and peace be upon him). Neither any such ruler will be paid homage, who does not believe in Allah Almighty and His Messenger (grace, glory, blessings and peace be upon him), nor it will be yielded in such a matter, which is against the Will of Allah Almighty and His Messenger (grace, glory, blessings and peace be upon him), and nor such law will be respected, which is against the Laws of Allah Almighty and His Messenger (grace, glory, blessings and peace be upon him).

Muslim doctors of law and religion opposed very oppressive and tyrant kings openly and did not bow their heads before their non-Islamic rules and regulations. Resultant they suffered countless afflictions.

Deposits and justice

         إِنَّ ٱللَّهَ يَأْمُرُكُمْ أَن تُؤَدُّوا۟ ٱلْأَمَٰنَٰتِ إِلَىٰٓ أَهْلِهَا وَإِذَاحَكَمْتُم بَيْنَ ٱلنَّاسِ أَن تَحْكُمُوا۟ بِٱلْعَدْلِ إِنَّ ٱللَّهَ نِعِمَّا يَعِظُكُم بِهِۦٓ إِنَّ ٱللَّهَ كَانَ سَمِيعًۢا بَصِيرًا 58

58.  Lo! Allah commandeth you that ye restore deposits to their owners, and if ye judge between mankind, ye judge justly. Lo! Comely is this which Allah admonisheth you. Lo! Allah is Ever – Hearer , Seer.
58.  ‘InnAllaaha  ya’-murukum  ‘an-tu- ‘addul- ‘amaanaati  ‘ilaaa  ‘ah-lihaa,  wa  ‘izaa  hakamtum  bay-nannaasi  ‘an-tah-kumuu  bil-‘adl.  ‘InnAllaaha  ni-‘immaa  ya- ‘izukum-bih.  ‘InnAllaaha  kaana  Samii-‘am- Basiiraa. 

Commentary

‘Al- ‘amaanaati – (The deposits), its singular is ‘amaanat. That is to say; the thing, which has been kept with someone for some times, and after some days, that is returned surely on demand. Ameen is that undefiled person, who does not embezzle in the deposits, returns it on demand without any evasion and reduction.   

Tu- ‘addul- ‘amaanaati   ‘ilaaa  ‘ah-lihaa – (ye restore (you should return the) deposits to their owners. tu- ‘addu (you should pay (return or restore). ‘ah-lihaa (to its owners), it means, those people who are owners of any deposits, moreover, those persons who are correct commendable and deserving of the trust. Its aim is that the deposits should not be handed over to the unworthy persons. In this revolution of time, the ballot (vote) is a very big national trust. To vote any incapable or enemy of the religion and faith is not less than national dishonesty.

It was manner of the Jews that they used to embezzle in the charge, used to support, show favor by taking bribe at the time of settling the disputes, and contradict the justice during finalization of the decisions. Allah Almighty has admonished the Muslims about both the badness in these verses. In this connection, it has also been narrated that when Messenger of Allah Almighty (grace, glory, blessings and peace be upon him) wished to enter the House of Allah on the day of victory of Makkah, at that time, Usman bin Talha was holding the key of the Masjidul-Haraam, and he denied to hand over the key and open the Door. Then Ali (may Allah be pleased with him) snatched the key from him and opened the Door. When Muhammad, Prophet of Allah Almighty (grace, glory, blessings and peace be upon him) came out from the Masjid after necessary deed, then Abbas (may Allah be pleased with him) requested the Beloved Messenger (grace, glory, blessings and peace be upon him) to grant him the key. In this situation, above-mentioned verse was revealed and the key was returned to Usman bin Talha. About which order of Justice and returning of charge, Allah Almighty has instructed us, that is entirely for our own interest. Allah Almighty knows very well about our open and hidden, present and future affairs. Therefore, if it seems any time that restoring of the deposits is not convenient, then this thinking should be ignored and command of Allah Almighty be obeyed.

Second Instruction is regarding Justice. It is a great work, if neither the right, nor truth is left from the hands in the affairs, law-suits and cases, and nor the justice is slaughtered. Justice is the spirit of Islam. Stability of peace and life of the world depends upon it.

Heaven’s blessings

Surah ‘An-Nisaaa’  (Women) – Chapter – 4)

(In the name of God, the Beneficent, the Merciful)

         وَٱلَّذِينَ ءَامَنُوا۟ وَعَمِلُوا۟ ٱلصَّٰلِحَٰتِ سَنُدْخِلُهُمْ جَنَّٰتٍ تَجْرِىمِن تَحْتِهَا ٱلْأَنْهَٰرُ خَٰلِدِينَ فِيهَآ أَبَدًا لَّهُمْ فِيهَآ أَزْوَٰجٌ مُّطَهَّرَةٌ وَنُدْخِلُهُمْ ظِلًّا ظَلِيلًا 57

57.  And as for those who believe and do good works, We shall make them enter Gardens underneath which rivers flow – to dwell therein for ever. There for them are pure companions – and We shall make them enter plenteous shade.            
57.Wallaziina  ‘aamanuu  wa  ‘amilus-saalihaati  saNud-khilu-hum  Jannaatin-tajrii  min- tah-tihal- ‘anhaaru  khaalidiina  fiihaaa  ‘abadaa.  Lahum  fiihaaa  ‘azwaajum-mutah-harah,  wa  Nud-khiluhum  zillan  zaliilaa.    

Commentary

After mentioning about the punishment and torment to the disbelievers (of the truth), now glad tiding of reward and retaliation for the persons who believed, has been described. It should impress on the mind that unavoidable condition with the Faith is ‘Righteous Deeds’. The words ‘amilus-saalihaati (Do good works) have been used nearly at every place in the verses of Holy Qur’an after the word ‘aamanuu (Believe) as it has been used in this verse. The same is the Truth that whose belief will be correct, his/her deeds will also be correct. How is it possible that a person has complete faith but one does not act upon it?

Jannaatin – its singular is Jannah, which means Garden (Paradise). Garden is such place, which is hidden by many trees. That is to say; the Garden, which has dense fruitful trees. It is the eternal favor (Paradise) of Allah Almighty, which will be residence of good disposition people. Its blessings will be evergreen and the life of the persons here will be perpetual. Neither the life (here) will face setting of the sun, nor end. The word ‘Abadan has been used only for the Paradise and its blessings.

‘azwaajum-mutah-harah – (pure companions, chaste women), the word mutah-haratun is from tahara. Tahaaratun and Tahuurun have also been derived from this word, which means pure, clean and clear. Singular of ‘azwaajun is Zawjun that means a couple, a pair, a husband (or a wife). For example Zawjun-na’l (pair of shoes), like this zawj of a man is a woman. Therefore, it aims wife too. Paradise is a great blessing. Clean atmosphere, pure life of that place, and chaste wife or husband will be good companions there.

At the end of the verse Allah Almighty commanded that shadows of the Paradise will be plenteous (zillan  zaliilaa). That is to say, there will never be heat of the sun, scorching sunshine and the disaster of the warmth. On the contrary, the Believers and pious persons will find there comfortable, joyous and easy life. They will be pleased with Allah Almighty and He will be pleased upon them.

Torment of the Hell

Surah ‘An-Nisaaa’  (Women) – Chapter – 4) 

‘A-‘uu-zu  Billaahi minash-Shay-taanir- Rajiim.

Bis-Millaahir-Rah-maanir-Rahiim.

(In the name of God, the Beneficent, the Merciful)

         فَمِنْهُم مَّنْ ءَامَنَ بِهِۦ وَمِنْهُم مَّن صَدَّ عَنْهُ وَكَفَىٰ بِجَهَنَّمَ سَعِيرًا 55

 إِنَّ ٱلَّذِينَ كَفَرُوا۟ بِـَٔايَٰتِنَا سَوْفَ نُصْلِيهِمْ نَارًا كُلَّمَا نَضِجَتْجُلُودُهُم بَدَّلْنَٰهُمْ جُلُودًا غَيْرَهَا لِيَذُوقُوا۟ ٱلْعَذَابَ إِنَّ ٱللَّهَ كَانَ عَزِيزًا حَكِيمًا 56

55.  And of them were (some) who believed therein and of them were (some) who turned away from it. And Hell is sufficient for (their) burning.

56.  Lo! Those who disbelieve Our Revelations, We shall expose them to the Fire. As often as their skins are consumed We shall exchange them for fresh skins that they may taste the torment. Lo! Allah is Ever Mighty, Wise.
55.  Faminhum-man  ‘aamana  bihii  wa  minhuman- sadda  ‘anh.  Wa  kafaa  bi-Jahannama  sa-‘iiraa. 


56.  ‘Innallaziina  kafaruu  bi- ‘AayaatiNaa  sawfa  nusliihim  Naaraa.  Kullamaa  nazijat  ju-luuduhum  baddalNaahum  ju-luudan  gayrahaa  li-yazuuqul- ‘azaab.  ‘InnAllaaha   kaana  ‘Aziizan   Hakiimaa.

Commentary

Punishment for the infidels and disbelievers has been described in this verse. Allah Almighty has bestowed grandeur always to the dynasty of Prophet Abraham (peace be upon him) and even now it is still in his family. The Fire of Hell is sufficient for him to burn, whosoever will not believe without grounds, only due to jealousy. It is impossible to escape and run away from that Fire.

In the previous verse, there was a description about the believer and disbeliever. In this verse, punishment for the disbeliever has been mentioned, so that the people incline towards the Faith and avoid from infidelity, they may draw attention towards their determined path after knowing about results of the deeds.  
  
Recitation regarding the Jews is continued. It is commanded that some of them embraced Islam and they entered in the list of Believers. There are some such people among them, who used to remain away from the path of truth. They did not believe at any cost. Bursting forth the Fire of Hell into flame is ready for such persons and it is sufficient for them.

Which type of torment will have to meet the disbelievers of the verses of Allah Almighty? Listen to (in the Word of) Allah Almighty, “We shall expose them to the Fire. As often as their skins are consumed We shall exchange them for fresh skins that they may taste the torment”. Blazing Fire of the Hell will reduce their skins to ashes but they will not die. Their skins will be exchanged by the fresh skins and they will taste the torment again and again. Their trouble and pain will not be reduced. ‘Al-’Amaan, wal-Hafiiz

Undoubtedly, Allah Almighty is Overcoming and Mighty. No difficulty comes before Him while punishing the infidels as much severely. He is Wise. To give such punishment to the disbelievers is very suitable in accordance with His Wisdom.

Misfortune of the Jews

Surah ‘An-Nisaaa’  (Women) – Chapter – 4) 

‘A-‘uu-zu  Billaahi minash-Shay-taanir- Rajiim.
(I seek refuge in God from Satan the outcast)

Bis-Millaahir-Rah-maanir-Rahiim.

(In the name of God, the Beneficent, the Merciful)

أَمْ لَهُمْ نَصِيبٌ مِّنَ ٱلْمُلْكِ فَإِذًالَّا يُؤْتُونَ ٱلنَّاسَ نَقِيرًا 53

 أَمْ يَحْسُدُونَ ٱلنَّاسَ عَلَىٰ مَآ ءَاتَىٰهُمُ ٱللَّهُ مِن فَضْلِهِۦ فَقَدْ ءَاتَيْنَآ ءَالَ إِبْرَٰهِيمَ ٱلْكِتَٰبَ وَٱلْحِكْمَةَ وَءَاتَيْنَٰهُم مُّلْكًاعَظِيمًا 54

53.  Or have they even a share in the Sovereignty? Then in that case, they would not give mankind even the speck on a date-stone.   

54.  Or are they jealous of mankind because of that which Allah of His Bounty hath bestowed upon them? “So We bestowed upon the house of Abraham (of old) the Scripture and Wisdom, and We bestowed on them a mighty kingdom.
53.  ‘Am  lahum  nasiibum-minal-mulki  fa-‘izal-laa  yu’-tuu-nannaasa  naqiiraa.  

54.  ‘Am  yahsuduu-nan-naasa  ‘alaa  maaa  ‘aataahu-mUllaahu  min-fazliH.  Fa-qad  ‘aatayNaaa  ‘Aala-‘Ibraahiimal-Kitaaba  wal-Hikmata  wa  ‘aatayNaahum-mul-kan  ‘aziimaa. 

Commentary

Occasion of this verse’s revelation has been described that the Children of Israel used to consider that prophet-hood and lord-ship of the religion was their hereditary and right. Moreover, it should remain only in the dynasty of the children of Israel in every reign. Therefore, they used to take it as their disgrace in obeying the last Messenger of Allah Almighty, Muhammad (grace, glory, blessings and peace be upon him), and say that ultimately they would succeed in getting sovereignty and kingdom. Due to saying the above-mentioned words by the Jews, this verse was revealed, “Have the Jews any share in the Sovereignty and kingdom?” It means that certainly they have no share. These people are so much stingy that if they become ruler or king, they will never give alms even equal to a seed of the sesame. That is to say; whenever they will get empire anywhere, they will not bestow on any beggar even equal to an atom.

Then Allah Almighty inquires, “Are the Jews grievous due to Bounty and the Liberality, which Allah Almighty has bestowed upon Muhammad, His last Messenger (grace, glory, blessings and peace be upon him) and His companions (sahaabah) (may Allah Almighty be pleased with them)? It is entirely their absurdity to envy for this purpose because We have bestowed upon the house of Abraham (peace be upon him) the Scripture and Wisdom, and We bestowed on them a mighty kingdom. Even now; these all are held in His (Abraham - peace be upon him) house as the last Prophet (grace, glory, blessings and peace be upon him) is from the descendants of Ishmael, who was too the son of Abraham (peace be upon them). Then it is not lawful for the Jews to envy and deny due to this reason.

When it was manifested upon the Jews that Muhammad (grace, glory, blessings and peace be upon him) was a True Prophet of Allah Almighty and Holy Qur’an is His Real Word, then it was better for them to believe in Allah Almighty, to embrace Islam and to become brothers of the Muslims instead of maintaining malice and jealousy in their hearts. But they were misled as much in the greed and avarice of worldly respect and honor, wealth and property that they did not care for the Commands of Allah Almighty. They used to burn in the fire of jealousy and avarice, to stand opposite upon the infidelity and denial, and to be exhausted of the friendship with the enemies of Islam. They also used to remain misers and do stinginess. How can prophet-hood and sovereignty be given to the people like These?
