Commentary

Some verses prior to the mention about “the bequest and the executor”, it was described that every individual should think upon oneself deeply. That person is not harmed against the depravity of any other, who is right personally. As though, others’ good works and fairness will not be useful for that person, who is evildoer until he does not correct and change himself.

It was explained that Unto Allah Almighty you will all return; at that time Allah Almighty will inform you of what you used to do. As if, we should be operative in the world keeping this rule in view that reality of our all works and deeds will be opened before Allah Almighty. The entire acts (good or bad) will be examined and re-measured. After that a likeness about doing works correctly has been exemplified, by means of which; the executor has been urged to keep himself honest, and the remedy of dishonesty has been described.

This subject has been cleared in such a manner that all the humankind will be gathered before Allah Almighty on the Day of Resurrection. Allah Almighty will ask the entire Messengers (peace be upon Them) after collecting them: What was the reply of the people, when you admonished them and called towards the good works? They will say: We do not know about it, whether they obeyed or rejected us, because belief and disbelief is related with the heart, which is a hidden thing. Nobody knows the condition of the hidden things except Allah Almighty. It was our duty to convey Your Message until we lived among them. We used to deliver Your Message and display it unto them by acting ourselves upon Your Instructions. Even during that period, we were unable to know about real condition of their hearts. Then we were demised. After that only You know the state of their belief or disbelief. Only You are able to Know about those things, which cannot be seen by us, except it that, which, to whom and how much You desire to tell.

Common people have been warned from this description: While the Messengers (peace be upon Them) would not be able to be saved from query, then how will you be saved?

Commentary

(Continued from the last)

 - and let them swear (saying): Verily our testimony is truer than their testimony and we have not transgressed (the bounds of duty), for then indeed we should be of the evildoers. Allah Almighty says: Swearing in this manner will be hopefully more powerful. They will bear true witness or fear that their oaths may be rejected too like the oaths of earlier executors.

When the heirs of the testator brought the case again unto the Messenger (grace, glory, blessings and peace be upon Him) and could not arrange the witnesses, then He (grace, glory, blessings and peace be upon Him) called two nearly concerned persons and commanded them to stand up and administered an oath from them because they were denying the executors’ claim of truth.

It is considerable that how much little matters have been explained very clearly in the Word of Allah Almighty (Holy Qur’aan)? It aims that the deeds, acts and mutual relations of the mankind may be corrected as his beliefs and manners. Nobody may violate the right of any other, and if any sinner violates it, then it may be compensated, because the trial of the entire religion is “(Social ) Affairs” only.

Then it is commanded that the entire matters will be correct at the very time when fear of Allah Almighty will be in the heart and everyone will try to be saved from the evil deeds due to the fear of punishment and His commands will be listened carefully. So it is being reminded again and again “Be mindful of your duty to Allah and hearken. And whosoever neither frightens from Him, nor listens to His Command, if that person is not a disobedient then what is he/she? And it is a Rule prescribed by Allah Almighty that He does not guide the disobedient towards the Straight Path and they go astray, who neither fear from any threat, nor hearken the truth.

Commentary

During the time of the Messenger of Allah Almighty (grace, glory, blessings and peace be upon Him), a Muslim named Badiil and two Christians named Tiim and ‘Adii went on campaigning in the land together. Badiil died in the way, but before death he gave his entire property in the charge of both Christians, so that they should hand it over to his heirs.

After reaching back they handed over the goods to its heirs. A list of the entire articles was found in the luggage by the heirs. Then they knew that a silver bowl does not exist in the luggage which was golden electroplated. The Christians were asked about it but they replied, “We have nothing more. That bowl was spent on medicament of the deceased person. Thereupon the heirs reported the case to the Messenger (grace, glory, blessings and peace be upon Him) and requested that a bowl was missing. On that, He (grace, glory, blessings and peace be upon Him) administered an oath from the Christians in accordance with the previous verse. They both swore that the total luggage was this and they had seized nothing. The Messenger (grace, glory, blessings and peace be upon Him) absolved them.

After a few days, that bowl was found on a goldsmith shop and the shop-keeper told that the bowl was sold to him by Tiim and ‘Adii. Then the case was decided according to this verse, because the heirs did not have witnesses. It is commanded that if it is ascertained afterwards that both of them have been guilty of dishonesty and have seized some goods, and their oath was false, let two others take their place of those nearly concerned, and let them swear -

Commentary

It was described in the previous part of this verse that the best form of appointing any executor is that two reliable Muslims should be appointed. However during journey, two non-Muslims can also be appointed. In this verse, it has been explained that if the heirs doubt that some part of inheritance of the dead has been misappropriated by the executors and they have not worked honestly. But the witnesses are not available to prove the misappropriation. In this condition, an oath would be administered from the executors that they did not embezzle. And this oath will be taken from them after the prayer. The commentators of the Holy Word (Qur’aan) have explained that administration of the oath after the time of ‘Asr prayer is more reasonable. Otherwise, every oath can be administered after every prayer, because anyhow, everybody has more fear of God Almighty after the worship than other times.

It is commanded, “If you have doubt on the executors that they are dishonest and you have not any witness to prove their dishonesty, then you should stop the both executors after prayer and they should swear before the entire people upon this matter that they are honest”, and they should say, “Certainly neither we desire to embezzle any part of heritage falsely, nor we have any greed of wealth and nor relationship can stir us up for dishonesty that we cause to give more part of heritage to any near kinsman”. They should also say, “We swear by Allah Almighty that we shall neither give any false evidence on His name, nor put off His command and nor hide the Truth. If we do so, then indeed we should be of the sinful”.

Such an incident was happened during the time of the Messenger of Allah Almighty (grace, glory, blessings and peace be upon Him), in which there were two Christians appointed as the executors. There was a doubt in their honesty. So an oath was administered from them.

Commentary

Method of appointing any person as executor to carry into effect the will of a testator, who is at the point of death, is being explained in this verse. The executor is the person; whom any testator gives in charge of his/her property/wealth, so that the executor may hand over it to the heirs. Appointing two Men as executors, who should be just Muslims, is better, because nevertheless, a Muslim (Believer) can never be a faithless. However, if the persons of required standard are not available, then any two common persons from among the Muslims can be appointed as executors. But if someone is campaigning in the land and the calamity of death befall him/her, then any non-Muslim can also be appointed as the executor.

It is commanded that the Muslims should adopt the way that if they make someone executor at the time of death, then there should be two executors; who should be Muslims and Just. It aims that those should be such persons; upon whom everyone have faith and they should be famous in honesty. If such kind of executors is not available, then two persons from the Muslim community (condition of whom is not known) may be appointed, because a Muslim cannot be a dishonest.

Maximum scholars of the religion have faith that any non-Muslim can be appointed as executor if the Muslim is not available. Otherwise, only any Muslim should be appointed as executor. It has the reason that during the ancient days, only the Muslims were such people who were considered pure from dishonesty. Unfortunately, nowadays, the Disbelievers and Idolaters are deemed more faithful, honest and just than the Muslims. The Muslims should take warning from it.

Commentary

One such rule has been described for the Muslims in this verse, which is useful for the entire human beings and everybody can find the Straight Path by acting upon it. That Rule is: Every individual is responsible of one’s own deeds. None should harm oneself in imitation of one another. But it is incumbent that one should refrain from such works, and as far as it may be possible, one should try to prevent others too from the evil deeds. If anyone does not accept, one should not be distressed; let them do their own job.

The Muslims are being commanded that it is necessary for them to save their souls from destruction. Moreover, they should cause to know all other people that they will suffer misfortune of their own evil deeds. So every person should abstain from evil works. If they turn off your advice with a joke or deny accepting, they mar their own. They can never injure you, even that they are unable to perish any hair of you. If you will do as they do, you will harm yourselves in imitation of others by involving yourselves in evil deeds, and it is not befitting for any wise person to injure oneself.

Commit it to your mind! You all people would have to return unto Allah Almighty; on that Day (the Day of Resurrection), He will show you that every mankind would have to suffer the punishment of one’s own evil deeds and in imitation of whom one was involved in evils, they will never be helpful for the one whether they were fathers, ancestors or anyone else.

It is known from this description that “Think properly before you do any work” that “the one is responsible oneself of one’s own deeds”. If that is a bad work, give it up and never do, otherwise, the one will be punished properly. It is the responsibility of every Muslim to prevent others from committing any evil work and the best method of conveying the message of Islam to others, is that “the one should do good works personally, so that the other people do also in imitation, observing the one”.

Commentary

In this verse, fundamental education of Islam has been described in an interesting way. Islam is desirous that every command of Allah Almighty and saying of His Messenger (grace, glory, blessings and peace be upon Him) should be obeyed and acted upon. If traditions, customs and ways of life of our ancestors are against Islam, those should be given up entirely, because those manners and customs have no proof of their being good, while the commands of Allah Almighty and His Messenger (grace, glory, blessings and peace be upon Him) have proof as well as responsibility of deliverance and success along with it too. So, this evasion that “how can we give up that tradition, wherein we found our ancestors?” is quite debauch and loosely. Its nonsense may be judged easily by using sense a little.

It is commanded that when the people are invited towards the prescribed Way of Allah Almighty and His Messenger (grace, glory, blessings and peace be upon Him), they allege falsely: “Enough for us is that path, which our ancestors have left behind for us. They used to act upon these traditions and teach us the same”. In their reply, it has been described: Ask them, “Whether is it possible that your fathers may be unaware of the original knowledge or impossible? Is it not possible that they did not know the correct way? Would you like to follow them even then in such condition? It seems against the sense”.

It is visible that if any knower more than them and who is well aware of the paths, says that the path, on which they used to go forth and guided their children to follow them, at last would lead and let them fall in a dry well filled up with rubbish, and then it would not be possible to come out from it, then certainly the talk of that experienced and well acquainted person was able to be listened and believed.
